Ministry of Commerce Announcement No.13 of 2018 on Countervailing Investigation on Imported Sorghum Originating in the United States

Article 18 of the Countervailing Regulations of the People's Republic of China stipulates: "Under special circumstances, the Ministry of Commerce may decide to file a case for investigation if it has not received a written application for countervailing investigation, but has sufficient evidence to believe that there is a causal relationship between subsidy and injury." Preliminary evidence and information obtained by the Ministry of Commerce show that imported sorghum originating in the United States has received subsidies from the United States Government. At the same time, the number of products entering the Chinese market has increased substantially, and the price has continued to decline.The price of similar products in China's domestic industry has been reduced and restrained, and the relevant economic indicators of similar products in the domestic industry are deteriorating. Preliminary evidence and information obtained by the Ministry of Commerce also show that U.S. sorghum production is huge and stocks have increased, with U.S. sorghum exports accounting for more than 50% of its production since 2013. The preliminary evidence and information obtained by the Ministry of Commerce show that China's domestic industry has suffered substantial damage and the threat of substantial damage, and that there is a causal relationship between the subsidies received by imported products from the United States and the substantial damage and the threat of substantial damage to domestic industries. According to Article 18 of the Countervailing Regulations of the People's Republic of China, the Ministry of Commerce decided to conduct a countervailing investigation on imported sorghum originating in the United States from February 4, 2018. The relevant matters are hereby announced as follows:

I. Filing Investigation and Investigation Period Since the date of this announcement, the Ministry of Commerce has conducted a countervailing investigation on imported sorghum originating in the United States. The subsidy investigation period determined in this investigation is from November 1, 2016 to October 31, 2017, and the industry injury investigation period is from January 1, 2013 to October 31, 2017. II. Products under Investigation and Scope of Investigation Scope of investigation: imported sorghum originating in the United States.Product name under investigation: sorghum, also known as edible sorghum. English name: Grain Sorghum Product description: Sorghum is a cereal crop with unique stress resistance and adaptability. The 1000-grain weight of sorghum is usually below 35.0 G, including the varieties with very large grain weight above 35.0 G. Main uses: It can be eaten directly, and can also be used for brewing, feed, energy processing, etc.The product is classified under the Import and Export Tariff of the People's Republic of China 10079000. III. Countervailing Investigation Items According to the relevant evidence and information, the Ministry of Commerce has decided to investigate the following subsidy items in this investigation: 1. Crop Insurance Program 2. Price Loss Protection Project 3. Agricultural Risk Guarantee Project 4. Marketing Loan Program 5.Export Credit Guarantee Project 6. Market Access Project 7. Foreign Market Development Partner Project 4. Register to participate in the survey Any interested party or the government of an interested country (region) may register with the Trade Remedy and Investigation Bureau of the Ministry of Commerce to participate in this countervailing investigation within 20 days from the date of promulgation of this announcement. The interested parties participating in the investigation and the government of the interested country (region) shall, in accordance with the Reference Format for Registration to Participate in the Investigation, provide explanatory materials such as basic identity information, quantity and amount of products under investigation exported or imported to China, quantity and amount of similar products produced and sold, and related information.The Reference Format for Registration to Participate in the Survey can be downloaded from the relevant website (website attached, the same below). The interested parties referred to in this announcement refer to the individuals and organizations specified in Article 19 of the Countervailing Regulations of the People's Republic of China. 5. Access to public information In the process of investigation, interested parties and governments of interested countries (regions) may consult the public information of the case through relevant websites, or go to the Trade Remedy Public Information Reference Room of the Ministry of Commerce (Tel: 0086-10-65197878) Search, read, transcribe and copy the public information of the case. VI. Comments on filing a case If interested parties and governments of interested countries (regions) need to comment on the product scope of this investigation, the countries (regions) under investigation and other relevant issues, they may submit their written opinions to the Trade Remedy and Investigation Bureau of the Ministry of Commerce within 20 days from the date of publication of this announcement. VII. Methods of investigation According to the provisions of Article 20 of the Countervailing Regulations of the People's Republic of China, the Ministry of Commerce may use questionnaires, sampling, hearings, on-site verification and other means to obtain information from relevant interested parties and governments of interested countries (regions) and conduct investigations.In order to obtain the information required for the investigation of this case, the Ministry of Commerce usually issues questionnaires to the foreign exporters or producers involved in the case, domestic producers, domestic importers and the governments of interested countries (regions) within 10 working days from the deadline for registration to participate in the investigation stipulated in this announcement. Interested parties and governments of interested countries (regions) registered to participate in the investigation may also download the Questionnaire for Foreign Exporters or Producers of Sorghum Countervailing Cases, the Questionnaire for Domestic Producers of Sorghum Countervailing Cases,Questionnaire on Domestic Importers of Sorghum Countervailing Case and Government Questionnaire on Sorghum Countervailing Case. Other interested parties and governments of interested countries (regions) that have not registered to participate in the survey may directly download the above questionnaires from relevant websites, or request the above questionnaires from the Trade Remedy and Investigation Bureau of the Ministry of Commerce, and fill them in as required. All interested parties and the governments of interested countries (regions) shall submit complete and accurate answers within the prescribed time. The response should include all the information requested in the questionnaire.

VIII. Submission and Handling of Confidential Information If the information submitted to the Ministry of Commerce by an interested party or the government of an interested country (region) needs to be kept confidential, it may submit a request to the Ministry of Commerce for confidential treatment of the relevant information and explain the reasons. If the Ministry of Commerce agrees to its request, the interested party applying for confidentiality and the government of the interested country (region) shall provide a non-confidential summary of the confidential information at the same time. The non-confidential summary shall contain sufficient meaningful information to enable other interested parties to have a reasonable understanding of the confidential information.If a non-confidential summary cannot be provided, the reason shall be stated. If the information submitted by the interested party or the government of the interested country (region) does not indicate that it needs to be kept confidential, the Ministry of Commerce will regard the information as public information. IX. Consequences of non-cooperation According to Article 21 of the Countervailing Regulations of the People's Republic of China, when the Ministry of Commerce conducts an investigation, the interested parties and the governments of interested countries (regions) shall truthfully reflect the situation and provide relevant information.If an interested party or the government of an interested country (region) fails to truthfully reflect the situation and provide relevant information, or fails to provide necessary information within a reasonable time, or seriously obstructs the investigation by other means, the Ministry of Commerce may make a ruling on the basis of available facts. X. Time limit for investigation This survey began on February 4, 2018, and should normally be completed by February 4, 2019, and may be extended to August 4, 2019 under special circumstances.XI.
